These terms govern how teachers, schools and publishers use the Pomegranate service, and how anyone uses our website, pomegranate.so. They sit alongside our Privacy Policy and our Cookie Policy.
1. About these terms
Pomegranate is provided by Fuzzy EdTech Inc ("FuzzyEd", "we"), a company incorporated in British Columbia, Canada (BC1420030), of #200 - 2227 St. Johns St., Port Moody, BC V3H 2A6.
By creating an account or using Pomegranate you agree to these terms. If you only visit our website without an account, section 16 applies to you, together with sections 13, 15 and 17. If you use Pomegranate on behalf of a school, you confirm you are allowed to accept them for that school. Where a school or partner has a signed agreement with us, that agreement wins if it conflicts with these terms.
2. Who can use Pomegranate
- Pomegranate is for teachers, school staff and education publishers. You must be at least 18.
- Pomegranate is not designed for students. Do not create student accounts, and do not enter student personal information.
- There are three kinds of role: your own account, school roles (School Administrator, School User) and publisher roles (Publisher Administrator, Editor, Sales, Sales Editor). A School Administrator manages who has access for their school.
3. Your account and security
- Each account belongs to one person and is identified by their email address. Do not share accounts or passwords.
- Use a strong password, and turn on multi-factor authentication (MFA). We are making MFA mandatory for School Administrators and publisher roles, and a school can require it for all its users.
- Keep your sign-in details private, and tell us at security@pomegranate.so straight away if you think someone else has used your account.
- You are responsible for what happens under your account, unless it happened because of a failure on our side.
4. Schools
- A school subscribes for a number of seats. Its School Administrators invite teachers, assign seats and remove users. A publisher's sales team can also manage seats for schools that subscribe to its content.
- The school decides who in the school may use Pomegranate, and must remove access for staff who leave.
- When a school's subscription ends, its teachers keep their own accounts and the boards they created, but lose access to subscribed content. School Administrators can still manage the school's users. A school can ask us to delete its data at any time (section 10).
5. Subscriptions and payment
- Free features are available without payment. Paid plans and content bundles are sold by our publishing partners, such as Maths — No Problem!, who collect payment under their own terms of sale. Access is then set up in Pomegranate through a school subscription or a redemption code.
- Prices, billing, renewal and refunds for plans bought from a partner are set by that partner.
- Where we sell plans directly, prices, renewal and refund terms are shown before you buy, and payment is handled by our payment provider under the terms shown at checkout. We do not store card details.
- When a partner subscription ends or is cancelled, access to subscribed content ends on the date the partner gives us.
- Schools that need an invoice or purchase order should contact the partner they bought from.
- Redemption codes are single use, cannot be exchanged for cash, and may have an expiry date.
6. Your content
- You keep ownership of the boards, lessons and files you create or upload.
- You give FuzzyEd a non-exclusive licence to store, copy, display and process your content only so we can run Pomegranate for you and the people you share it with. The licence ends when you delete the content or your account, apart from backup copies, which expire on their normal schedule (section 10).
- If you publish a listing on the marketplace, the licence also covers showing and distributing that listing to buyers until you remove it. Copies already bought stay available to the buyer.
- You confirm you have the right to upload your content, and that it does not infringe anyone else's rights.
- We do not use your content to advertise to you or others, and we do not sell it.
7. Licensed content
Some content in Pomegranate belongs to FuzzyEd or to publishers such as Maths — No Problem!. You may use it in your teaching while your subscription or licence is active. You may not copy it out of Pomegranate, resell it, or remove copyright notices. Licensed content is not part of your data, so it is not included in a data export.
8. Acceptable use
When you use Pomegranate you must not:
- upload or share content that is unlawful, abusive, hateful, sexually explicit, threatening, or harmful to children;
- enter student personal information, or anyone's sensitive personal information;
- infringe copyright or other rights, including copying licensed content out of Pomegranate;
- share your account, use someone else's, or try to reach data you are not authorized to see, including another school's;
- probe, scan or test Pomegranate's security without our written permission, or interfere with the service (malware, denial of service, automated scraping, bypassing rate limits or bot protection);
- use Pomegranate to send spam or to advertise unrelated products.
If you find a security vulnerability, report it to security@pomegranate.so. We will acknowledge it within 2 business days and will not take action against good-faith reports.
9. Reporting content
- Anyone can report content they think breaks these terms by emailing report@pomegranate.so.
- We review reports as soon as we reasonably can. Content that is illegal or puts someone at risk is removed at once, and reported to the police or the eSafety Commissioner where the law requires.
- We tell the person who posted the content what was removed and why, unless the law or someone's safety prevents it. They can ask us to review the decision.
10. Privacy and your data
The Privacy Policy explains what personal information we collect and why. In short:
- Pomegranate data is stored in AWS in Ireland, with backup copies in Stockholm, Sweden. The providers that process data for us are listed on our sub-processors page.
- You can ask us at any time to export your account details, boards and uploaded files, free of charge. We send the export within 30 days.
- You can ask us to delete your account, or a School Administrator can ask us to delete the school's data. We delete it within 30 days and confirm in writing. Backup copies expire automatically within 90 days.
- Accounts with no sign-in for 24 months and no active school subscription are deleted after two email warnings.
- If a security incident affects your data, we tell the affected school as soon as possible, and no later than 48 hours after confirming it, and notify regulators as the law requires.
- We give at least 30 days' notice before adding a provider that handles your personal information, or moving your data to a new country.
10A. Data protection terms for schools
Where a school subscribes to Pomegranate, the school is the controller of the personal information its staff put into Pomegranate, and FuzzyEd is its processor. These terms are the written contract between us for that processing. For that information, FuzzyEd will:
- process it only to provide Pomegranate and on the school's documented instructions, which are these terms and the school's use of the service's settings;
- make sure everyone who can access it is bound by confidentiality;
- keep the security measures described in our Privacy Policy in place;
- use only the sub-processors listed on our sub-processors page, under written terms at least as protective as these; give the school at least 30 days' notice before adding a sub-processor or moving data to a new country; and let the school end its subscription and export its data if we cannot meet its objection;
- help the school respond to requests from its staff to exercise their privacy rights, and with any privacy impact assessment or regulator enquiry about Pomegranate;
- tell the school as soon as possible, and no later than 48 hours after confirming a security incident affecting its data, and help it meet its own notification duties;
- at the end of the subscription, or on request, delete the school's data within 30 days and confirm this in writing, after offering an export (backup copies expire within 90 days);
- give the school the information it reasonably needs to show we meet these terms, and allow an audit on 14 days' notice during normal working hours, no more than once a year unless there has been a security incident; and
- transfer the information outside its home country only as described in our Privacy Policy.
A school that needs a signed data processing agreement can ask for one at privacy@pomegranate.so.
11. Availability and changes to the service
- We aim to keep Pomegranate available at all times, but do not guarantee uninterrupted service. Our recovery target after a major outage is 24 hours.
- We give at least 5 business days' notice of planned downtime longer than 15 minutes.
- We may improve or change features. We give at least 14 days' notice before removing a feature or changing how schools manage their teachers, permissions or MFA.
12. Suspension and closing accounts
- You can close your account at any time from your account settings or by contacting us.
- We may suspend or close an account that breaks these terms, puts other users or their data at risk, or is required by law. Where it is safe to, we tell you first and give you a chance to fix the problem and export your data.
- If we stop offering Pomegranate, we give at least 90 days' notice so schools and teachers can export their data.
13. Warranties and liability
- Pomegranate is provided as it is and as available. We do not promise it will meet every need or be free of errors.
- To the extent the law allows, our total liability to you in any 12 months is limited to the amount you paid us in that period, and we are not liable for indirect or consequential loss.
- Nothing in these terms limits rights you have under consumer law that cannot be excluded, including the Australian Consumer Law, the NZ Consumer Guarantees Act 1993 and UK consumer law, or liability for fraud, or for death or personal injury caused by negligence.
14. Changes to these terms
We may update these terms. For a material change we give at least 30 days' notice by email and in the app, and the new terms apply from the date in the notice. If you don't agree, you can close your account before then.
15. Governing law
These terms are governed by the laws of British Columbia, Canada. This does not take away protections you have under the laws of the country you live in.
16. Using our website
This section applies to everyone who visits pomegranate.so, with or without an account.
- You must not use the website unlawfully or to harass, deceive or harm anyone, try to gain unauthorised access to it or to any system connected to it, or attack it (including malware, denial of service, automated scraping or bypassing bot protection). Misuse may be a criminal offence, and we may report it and stop your access.
- We or our licensors own the content on the website. You may use it for your own non-commercial teaching and share links to it. Any other use needs our permission.
- Website content is general information. We work to keep it accurate and up to date, but we do not guarantee that it is complete or current, or that the website will always be available or free of errors.
- Links to other sites are provided for convenience. We do not control those sites and are not responsible for their content. You may link to our website, as long as you do not suggest an association or endorsement that does not exist.
- To the extent the law allows, we are not liable for loss or damage arising from your use of, or inability to use, the website, its content or sites linked from it. Section 13 still protects your rights under consumer law.
- We may update this section by changing this page and the date at the top. Section 14 applies to changes that affect account holders.
